.PW First TLD To Adopt Uniform Rapid Suspension Rights Protection Mechanism

By doing so, the .pw Registry becomes the first TLD to adopt the newest rights protection mechanism from ICANN. URS offers brand owners a highly effective, quick and inexpensive mechanism to eliminate names that violate their trademarks. The URS seeks to provide trademark holders with faster protection against infringement than the existing Uniform Domain Name Dispute Resolution Policy (UDRP). While the UDRP, a more expensive and long process, awards ownership of a domain to the winner of a dispute, the URS ensures faster protection by immediately suspending the infringing domain and then proceeding to a trial. The URS also discourages infringement and wrongful cases by charging trial fees from the unsuccessful applicant.

Kristine Dorrain, Director of Internet and IP Services, National Arbitration Forum (NAF) commented, “The National Arbitration Forum is pleased that .pw Registry has selected the URS as one of its dispute resolution options. Currently, .pw Registry is the first and only voluntary adopter of URS, in advance of the new gTLD program. The adoption of URS, in addition to UDRP, demonstrates .pw Registry’s commitment to protecting the .pw domain name space from cybersquatting activity.”

Mr. Ramchandani added, “The URS is a compulsory feature for all new gTLDs and our advance implementation will give NAF, brand owners, registries, registrars and ICANN an opportunity to test its effectiveness in a live environment. One of our goals in the adoption of URS is also to help the community by ensuring a more refined and predictable experience when the URS roll-out takes place across more than a thousand new gTLDs. Single Character Domains To Be Auctioned By .PW Registry

Hard to come by in any top level domain (TLD), single character domain names have sold for high auction prices, irrespective of the TLD. The names P.pw and W.pw, for example, have already been sold for $8000 each. U.pw, the domain name of viral social media site Upworthy, was also sold recently for an undisclosed amount.

Upworthy co-founder and CEO, Eli Parisier said, “U.pw is a terrific branding opportunity for us. It’s as short as you can get, easily recognizable, and really cool.”

.pw Registry has seen over 250,000 domain names being registered within the first 3 months since the start of its General Availability phase, making it the most successful TLD launch since .co.

The new domain names will be available through NameJet. All applicants wishing to participate in the .pw single character auction need to register on Namejet before July 12, 2013 for the auction lasting from July 12, 2013 to July 16, 2013.

.PW Becomes Spammer’s Favourite

.PW, the ccTLD for the tiny Pacific island state of Palau that has been rebranded for the “professional web”, has been accused of becoming a haven for spammers.

According to a report in TechNewsWorld, “antispam vendors are now working to update their filters, and the original registrar is assisting in their efforts.”

.PW domains are offered relatively cheaply, making them attractive to spammers.

“This came out of nowhere,” Eric Park, a senior antispam analyst with Symantec told TechNewsWorld.

“If you look at our TLD distribution, .com, .ru, .info — those are usually at the top of our list,” he said.

“But PW was by far the runaway number — even more than .com,” Park added.

According to the report, “not only is Symantec bolstering its filters to block the spam, but it’s also working with the owner of the domain to help curb abuse of it.”

“The registrar, from what I can tell, is interested in action to take the spammers down,” he said. “Not all registrars care, but these guys seem interested in working with us to shut them out because it’s damaging the brand they’re trying to push.”

.PW Registry Extends Sunrise to Provide Additional Cover for Trademark Holders

Professional Web logoThe Registry for .PW – the Professional Web, today announced that the Sunrise Period will be extended for a week, until 15th February, 2013. Sunrise was originally scheduled to end on 8th February and has been extended further based on the late interest from brand owners.

Once a namespace reaches General Availability, domain names are available on a first-come, first-serve basis. To avoid brand name infringement in such scenarios, a restricted phase is opened exclusively for trademark holders, commonly known as the Sunrise Period.

“Trademark owners were protecting their presence in the .PW namespace at a constant pace, however last week we experienced a persistent spike in the number of applications submitted. ccTLD Updates for .xxx, .pw, .ru, .fr, .nl, .ee, vn, .be, .no

“What has really happened as a result of .XXX?” one year on from its launch is the focus of an article on Xbiz.

The article notes that “among other things, new sites have come to market, new companies have formed to capitalise on new opportunities in the adult space and a level of accountability and oversight added to an industry that has long shunned supervision of any sort — while the majority of trademark disputes have been swiftly resolved in favour of the legitimate rights holders.”

And it notes that ICM Registry’s Stuart Lawley claims .XXX “has comfortably exceeded the company’s sales expectations — based on the figures it communicated back in 2003 and 2004 in its original application to ICANN.” ICM also believes renewal rates will be high, even though the first anniversary is not quite here.

The .pw ccTLD is relaunching being branded as ‘the Professional Web, with the new registry opening up a 68-day sunrise programme as of 3 December. The sunrise offers some unique features aimed at reducing overhead for brand-owners.

A guest posting on DomainNameNews from Kate Moran of TM.Biz, .pw’s trademark validation agent, looked at trademark validation for .PW. Unsurprisingly the posting considers .pw a leader, saying “the .pw registry is proposing to protect not only exact matches, but also any domain containing the trademark, misspellings, abbreviations and language translations of the validated trademark. The trademark validation agent, TM.Biz is coupling these rules with automated searches of 70 trademark databases.”

On 4 December, the Coordination Center for TLD RU/РФ and the Technical Center of Internet generated DNSSEC keys for .RU, one of the two Russian national domains. A formal event signified the first phase of signing .RU with DNSSEC, with all works expected to be finalised by the end of December 2012.

The .FR registry, Afnic, has released their December 2012 Domain Name Industry. The latest report looks at the growth rate for IPV6-compatible .fr domain names. In the report Afnic focuses on the success rate of Syreli claims in relation to the age of the domain name. Everything suggests that rights-holders are reactive and quickly intervene to enforce their rights via the Syreli procedure. The full report is available from the Afnic website here.

SIDN, the .nl registry, has published their final report of the 2012 Domain Name Debate. The debate examined issues such as availability of registrant’s details from Whois and drop catching. To check out the final report, check out the SIDN website here.

The price to registrars of .ee domain names will be cut by 11.8 percent on 1 March 2013, which will see the price cut from €17 to €15. Maximum registration periods will also be extended with options of two and three years.

Registrations of .vn domain names hit225,970 in the third quarter of 2012 according to VNNIC’s white paper on Vietnam’s internet.

Alternative Dispute Resolution celebrated its tenth birthday on 12 December, the .be registry dns.be announced. To mark the occasion, Cepina (the Belgian Centre for Arbitration and Mediation) organised a symposium in conjunction with DNS.be.

Norid, the registry for .no domain names, is again receiving reports on a company who tries to force Norwegian companies to buy domain names. The service is said to be offered to protect a company name or brand.

The issue may be a proposal to register a domain name within other top level domains, such as .com or .as, or they may suggest to register the domain name in different spellings, for instance with and without a hyphen. The company who offers services like this, often tells a story about other actors interested in buying the domain name, and that they need a quick decision.

 

Daily Wrap: .PW To Be A “gTLD”, More gTLD Bids Withdrawn, Civil Society Meets At ICANN Toronto And gTLD Confusion

It’s been a while since we’ve had a Daily Wrap, but here we go. Directi is to relaunch .PW, the ccTLD for Palau next week at the ICANN meeting in Toronto with a sunrise period due to start in December, Domain Incite reports. The relaunch will see .PW branded as “professional web”.

Palau is ranked 197th in the world in area out of 251 countries and principalities with 459 square kilometres – twice the size of Washington DC, and 218th in population out of 238 – 21,032 people, according to the CIA World Factbook.

And last week it was revealed two more gTLD applications have bitten the dust with .CIALIS and .CHATR being formally withdrawn. ELi Lilly & Co dropped its bid for .CIALIS and Rogers Communications withdrew its .CHATR application,” according to Domain Incite.

Public interest groups involved in ICANN will gather on 12 October in the leadup to the ICANN meeting in Toronto, Canada in an event called “ICANN & Internet Governance: Security & Freedom in a Connected World” sponsored by the Noncommercial Users Constituency (NCUC), the voice of civil society in ICANN, according to a post by Milton Mueller on the Internet Governance blog. “The policy conference will focus on key ICANN policy issues like the need to promote both cyber-security and human rights in the development of global internet policies.”

“The conference subtitle recognizes our shared twin goals of security and freedom, and questions to what extent must we sacrifice one for the other,” said meeting organizer Robin Gross whose organisation IP Justice is an NCUC member.

“Cyberspace is at a watershed moment. Global civil society, now increasingly recognised as an important stakeholder in cyberspace governance, needs to step up to the challenge,” Ron Deibert, one of the event speakers, said in a release reported on Intellectual Property Watch. “What is required is nothing less than a serious and comprehensive security strategy for cyberspace that addresses the very real threats that plague governments and corporations, addresses national and other security concerns in a forthright manner, while protecting and preserving open networks of information and communication.”

Other speakers include new ICANN CEO Fadi Chehadé, Fiona Alexader from the US Department of Commerce and Wendy Seltzer, founder of the Chilling Effects Clearinghouse.

Panel topics include: Civil Liberties, Security and Law Enforcement; Controversial Top-Level Domain Names, Freedom of Expression and Intellectual Property Rights; The Changing Geo-Political Landscape of Internet Governance: Implications for ICANN; and Bringing Human Rights into ICANN’s Policy Development Process.

Meanwhile on gTLD Strategy, a blog post from Fairwinds Partners, there is a story on public confusion when new gTLDs come into being. The story notes a British electronics story Currys that has on its stories “Currys.digital.” The only applicant for .DIGITAL was Donuts. If successful, “it will be possible for the shop in the picture to go out and register the domain name Currys.Digital – but just because something is possible doesn’t necessarily mean it will happen.”

The article asks readers to “consider a scenario where Currys does not register its eponymous .DIGITAL domain name, but Boots, the well-known, UK-based pharmacy and drug store chain, applied for the .BOOTS gTLD. Imagine you’re a consumer and an average Internet user, walking down this street in London, and you see the sign that displays ‘Currys.Digital.’ Then, a short block later, you see a sign in the window of Boots that reads, ‘Visit us online at our new site: Pharmacy.Boots.’ Further up the road, there is another retailer whose name is SportsDirect.com.”
