Architelos Files For Bankruptcy Following Afilias Court Case

Architelos logoArchitelos, a consultancy and provider of tools for registry and DNS operators filed for bankruptcy Monday after it lost a court case brought by Afilias.

Architelos lost a patent lawsuit to Afilias last August, reports Domain Incite, with the jury setting “damages at $10 million, finding that Architelos had misappropriated Afilias trade secrets, but the trial judge recently indicated her intention of reducing the award to $2 million.”

However Architelos couldn’t afford even this and had “floated the idea of operating NameSentry on a revenue share with Afilias until its debt was paid.”

Architelos announced in a blog post by its CEO Alexa Raad that it “ceased operations [Monday] and commenced bankruptcy proceeding by filing a petition for Chapter 7 bankruptcy under provisions of Chapter 7 of Title 11 of the United States Bankruptcy Code. Unlike Chapter 11, which provides for reorganization and continuation of operations, Chapter 7 entails immediate cessation of company operations and an orderly liquidation of its assets.”

The company notes that “customers of the NameSentry service are not immediately impacted. NameSentry will continue to operate in the short term, however the decision on the continuation and or timing of the termination of the service will be up to the Trustee.”

ICANN participants logoStephen Crocker, ICANN’s Chair, has provided an update on the process to choose a successor to Fadi Chehadé. In short, Crocker says he “cannot say much more now” but that he ‘looks forward to giving a fuller update just as soon as he can.’ Chehadé is set to have his last day with ICANN on 12 March.

The .tickets gTLD has an interesting means of protecting against cybersquatting. It’s one that Domain Incite asks if it could be “the ultimate anti-cybersquatting system.”

The registry, Accent Media, “has launched an anti-cybersquatting measure that lets the world know who is trying to register what domain name a whole month before the domain is allowed to go live.”

“The service, at domains.watch, is currently only being used by .tickets, but it seems to be geared up to accept other TLDs too.” There are two processes for registrations – “fast track” and “standard”. The former “is for organisations with trademarks matching their names. It take five days for the trademark to be verified and the domain to go live.”

“Instagram has launched legal proceedings in the US in a bid to have a 2011 domain name purchase agreement upheld and block a ‘sham’ lawsuit in China” reports IPPro. Facebook paid $100,000 for the domain in 2011, which was previously owned by a Chinese registrant. The registrant, Murong Zhou, has “along with other family members, has made a business out of squatting on domain names containing famous trademarks, including Instagram’s, according to the district court complaint.”

Afilias was recently awarded a whopping $10 million in a court case against Architelos in a “trades secrets case” reports Domain Incite. A jury decided Architelos “had misappropriated trade secrets from Afilias in order to build its patented NameSentry domain security service, may even be thrown a lifeline enabling it to continue business.”

“A little over a week ago, the judge ordered that the $10 million judgment originally imposed by the jury should be reduced to $2 million.” Even this reduced would be too much for Architelos that has suffered a loss of business since the decision. “But the judge seems to be considering an injunction that would enable Architelos to continue to exist.”

The .cars, .car and .auto gTLDs have got off to a flying start, financially at least, taking in over a clear $1 million during the Early Access Period according to Domain Incite. General Availability started on 20 January and followed the Sunrise and lucrative Early Access Period, the latter closed on 12 January.

One of the most prominent registrations was Apple’s registration of “a trio of domains related to cars” according to USA Today. The trio were apple.car, apple.auto and apple.cars.

NameSentry Lite is designed for new generic Top Level Domain (gTLDs) operators who expect limited security threats such as phishing, malware, pharming and spam (collectively known as “domain abuse”), but who still require monitoring and notification of such abuses for compliance purposes.

NameSentry Lite is the entry-level version of the NameSentry abuse detection and mitigation service and is based on NameSentry’s patent-pending technology. NameSentry Lite provides monthly reports summarizing the domains and URLs that were detected as security threats in a given gTLD. Architelos Publishes Second NameSentry Report, Releasing Data and Key Findings on Internet Safety and Comparative Rankings of over 70 TLDs

The report benchmarks the comparative safety of the Internet and its largest Top Level Domains (TLDs) by measuring by the prevalence of security threats such as malware, phishing, botnets, and spam. The findings indicate a 67% increase of domain names identified and listed as “abusive” by major blocklists from January to September 2013, and that at least 5.5% of newly registered domain names are being used to perpetrate security threats.

Report Finds Increase of “Abusive Domains” and Potential Lessons for New gTLDs

The findings indicate 67% increase of domain names identified and listed as “abusive” by major security blocklists from January to September 2013. These respected blocklists are used to protect Internet users by blocking malware, phishing, dangerous spam, and other threats. The majority of the domains on these blocklists were registered for the purpose of perpetrating abuse, with a small minority consisting of domains that were compromised by bad actors. From January to September of 2013, an estimated 5.5% of newly registered domains were listed. “This underscores prevalent practice of bad actors to use domain names for perpetrating security threats and then quickly moving to new ones,” said John Matson, COO of Architelos. “The increase in abusive use of domains is a challenge for the security and domain industries, and for the general Internet-using population.”

The first NameSentry Report covered January to May 2013, was released in July  and pioneered the concept of the Namespace Quality Index (NQI). NQI measures the relative concentration of abusive domain names in any given namespace, thus providing a comparative measure of safety. Specifically, the NQI measures the “number of reported abusive domain names/million Domains Under Management (DUM).” Taking a snapshot in May and then again in September, of the 15 TLDs with NQI ratings of “Excellent/Green” in the May, only 6% or four TLDs sustained their ranking by September, while the rest slipped to “Good/Yellow.” This demonstrates the challenge TLDs face to achieve and maintain an “Excellent/Green” rating. The number of “Good/Yellow” rated TLDs increased from 36 in number in May to 45 total in September and represented 63% or the majority of the 72 TLD studied. The number of “Caution/Orange”-rated TLDs increased slightly in number from 14 in May to 15 total in September; and the number of at “Risk/Red” rated TLDs increased slightly from 7 in May to 8 in September comprising 11% of all measured TLDs. Starting now and continuing through next year and beyond, more than 1,000 new gTLDs will be added to the Internet root. Regulated TLDs Generally Safer Than Unregulated TLDs: Architelos Study

Not all TLDs are equal. And some are safer than others. That’s the finding of a report from Architelos that looked at the number of abusive domain names in 72 TLDs around the world. The TLDs surveyed accounted for over 257 million domain names, or over 99 percent of the total domains in the world’s registries.The report found that “low prices, ineffectual registrars, and a lack of compliance and enforcement tend to attract abusive registrations, whereas restrictive registration policies and higher prices tend to deter abusive domain registrations.”Further, “TLD registries can be distinguished by how resistant they are to abusive registrations, and how active or passive the registry is in detecting and mitigating abuse.”The survey was conducted on the eve of the introduction of hundreds of new TLDs as a starting point to help determine if the new TLDs are more or less safe and secure than those already currently in existence.The survey sought to benchmark the “current state” of TLDs so any level of change could be determined based on facts and not ideological positions.The analysis was built on data in the Architelos’ patent-pending NameSentry Abuse Detection and Mitigation Service. Since its introduction in November 2012, NameSentry has been tracking and analysing abusive domain activity across the internet.Of the TLDs surveyed, it was found 0.4 percent of all domain names registered, or roughly 4,000 abusive domains per million, that are considered abusive.And 90 percent of these abusive domains were found when they were advertised in spam, with six percent involved in spreading malware. Phishing involved above 150,000 unique domains per year. Those domains involved in command-and-control botnets though are relatively rare, but have a disproportionate importance.Overall 15 TLDs, or 21 percent of those surveyed, were considered to have an excellent rating. Those included the only two gTLDs to get the excellent rating, .tel and .xxx, as well as .no, .nz, .ch and .au.Those with a good rating made up half the sample with 36 of the TLDs and included the two largest ccTLDs, .tk and .de, and .nl, the fifth largest ccTLD.The largest TLD of them all with over 40 percent of all registrations, .com, came in the next category, “exercise caution”, along with 13 other TLDs including .at, .eu, .uk, .org and .net.And there were seven TLDs (10%) with the worst rating, determined to be “at risk”, and this group included .info, .us, .ru, .asia and .cn.The full report from Architelos is available for download from:
