MySpace loses appeal for MySpace.co.uk

MySpace has lost an appeal for the domain name myspace.co.uk through an independent appeals panel reports The Register. In January Nominet’s Dispute Resolution Service ruled the domain name should be handed to Fox Interactive Media despite having been registered for six years before MySpace was founded by a small British ISP.

In January Nominet’s Dispute Resolution Service ruled the domain name should be handed to Fox Interactive Media despite having been registered for six years before MySpace was founded by a small British ISP.The registrant appealed, and according to the judgement seen by The Register, the domain name will stay with the original registrant Total Web Solutions. There is still the possibility of a High Court appeal.According to The Register, “[t]he panel rejected MySpace’s claim that it had rights to the domain because it is wholly descriptive of its business. The appeal then turned on two key issues to determine whether TWS’ registration and use of myspace.co.uk was ‘abusive’.” The issues were when did advertisements begin appearing the website for the domain name and how much control the website had of the advertisements that did appear on the website.To read the article in The Register, see www.theregister.co.uk/2008/04/29/myspace_domain_dispute_nominet_davies.
