French court to pirates: Three strikes and … then what?

[IDG] France’s highest legal authority has ruled as unconstitutional a government plan to cut off, without trial, Internet users accused of copyright infringement.The so-called “three strikes” law would have handed over the power to disconnect surfers to a newly created High Authority for the Distribution of Works and the Protection of Rights on the Internet (Hadopi). It was approved by the French Parliament in April but has not yet been signed into law.

France’s controversial attempt to crack down on Internet piracy was dealt a setback Wednesday when that country’s highest legal authority struck down a provision that would have denied Internet access to those who repeatedly download copyrighted material illegally.The French Constitutional Council rejected a key provision that would have given a newly created government agency the authority to cut off Internet access to those deemed to be copyright scofflaws after two warnings. The council said “free access to public communication services on line” was a human right that only a judge should have the power to disconnect.

France’s highest court has inflicted an embarrassing blow to President Sarkozy by cutting the heart out of a law that was supposed to put France in the forefront of the fight against piracy on the internet.The Constitutional Council declared access to the internet to be a basic human right, directly opposing the key points of Mr Sarkozy’s law, passed in April, which created the first internet police agency in the democratic world.
