Australian consumer watchdog ACCC loses case against Google for ‘misleading’ searchers

Taxpayers will foot Google’s legal bill after the federal government’s consumer regulator lost a court case against the internet giant for allegedly misleading consumers.The Federal Court has dismissed the Australian Competition & Consumer Commission’s case alleging that Google had misled consumers by disguising advertisements as search results.

Google has won a case against Australia’s consumer watchdog over allegations of misleading conduct.The Australian Competition and Consumer Commission took the web giant to the Federal Court, accusing it of contravening the Trade Practices Act.In particular, the ACCC accused Google of failing to properly distinguish ads, or sponsored links, from organic search results.

The consumer watchdog’s claims that Google engaged in misleading and deceptive conduct by not adequately distinguishing between advertisements and regular search results has been dismissed by the Federal Court.In a judgment handed down yesterday, Justice John Nicholas also dismissed the Australian Competition and Consumer Commission’s claim that Google was liable for advertisers using competitors’ names and trademarks in ”sponsored links”. Previously, Trading Post had admitted to using competitor car dealers’ names in the headlines of its advertising on Google.
