Apple did not violate Samsung patents – U.S. trade judge

Apple did not violate patents owned by Samsung Electronics in making the iPod touch, iPhone and iPad, a judge at the International Trade Commission said in a preliminary ruling on Friday.Apple and Samsung have taken their bruising patent disputes to some 10 countries as they vie for market share in the booming mobile industry. The U.S. International Trade Commission ruled that Apple’s iPhones, iPods, and iPads do not violate four Samsung patents, dealing a blow to Samsung’s legal offensive against Apple and its portable devices.The ruling is preliminary and needs to be approved by the ITC’s full six-member commission.

An administrative law judge at the U.S. International Trade Commission (USITC) has ruled that Apple does not infringe four computing and mobile patents held by Samsung.Administrative Law Judge James Gildea, in a preliminary ruling issued Friday, found that Apple has not infringed Samsung patents related to mobile communication devices, portable music and data processing devices and tablet computers. Gildea also ruled that for four other Samsung patents, a U.S. industry does not exist, suggesting that the USITC does not have jurisdiction to rule on those patents.
