Apple's failure in Australia's High Court to block Samsung's tablet is a serious setback

Samsung's Galaxy Tab 10.1 is set to be in Australian stores in time for Christmas after Apple's legal bid to ban its sale here hit a dead end in the country's highest court.

Samsung had been facing joyless Christmas sales for the Tab after it was forced to keep the device off the market in line with a temporary Federal Court injunction Apple won in mid-October.

Apple today lost its High Court bid to block the sale of Samsung's Galaxy Tab in Australia marking a serious setback in its patent war with the Korean electronics giant.

Apple had sought special leave from the High Court to have an injunction against the sale of the device here reinstated after the full bench of the Federal Court overturned it last week.

Samsung slays Apple in tablet war
Samsung's Galaxy Tab 10.1 will be on sale "next week" after the High Court today denied Apple's request to appeal against an earlier decision overturning the ban on the device.

Late last month the full bench of the Federal Court unanimously reversed a ruling that banned the Samsung Galaxy Tab 10.1 in Australia until a full hearing next year. The court had found that the original judge, in granting the temporary ban, didn't properly weigh up the strength of Apple's case.
